    mine went to texas too...since every single petition, opt ead, h1bs, I-140, etc were from tsc. i am assuming it was cos my address was in GA and my 485 based A# was also from TSC.

    i am already done with my biometrics in sept so i m hoping for a quick turnaround too.

    I'm going to Canada on vacation for 2 days. I've read that if yr I-94 is valid and even if yr visa is expired you can return to US (thru automcatic revalidation)
    till
    1. you have not applied for US visa in Canada
    2. you dont belong to a country declared as sponsoring terrorism.

    My question is if you surrender yr I-94 to a Canadian inspector while crossing in to Canada, what do you show US immigration people while coming back? Do they stamp something etc? Has anyone gone thru this or knows abt this?

    Hi,
    I know that many of us have this travel q in mind about after 485 appl travel.1..is it risk free to travel after ur 485 app(ofcourse after u get the receipt notice)but without advance parole if u have ur h1b stamped .
    2...shud there be any issue at the poe regarding absent ap with pending i 485 appl?
    3..can some1 be denied entry based on the above facts>?

    Overtime is paid only if you are a non-exempt employee - usually means you get paid hourly. If you are an exempt employee, then you are not eligible for overtime. Not sure if this is different in different states, but that is how it works in Ohio.

    Same is true here in CA (Only non-exempt employees get overtime).
    Again, check with your state agency regards to overtime pay..... or consult a employment attorney...

    In Ohio, they issue a DL for one year from the application for H1B extension if the H1B has not been approved yet. It might be the same case in NC as well - it might be worth checking.

    Why is Tata giving such huge donations to schools in US that are already established?
    I would think he should have given donations to schools or colleges in India that really need it. Especially in remote villages where there are no schools or proper infrastructure.

    Hi,
    This is really stupid of USCIS to assume that we would stay in the same position for 6-7 years before they can re open the case.

    I don't know the answer to your question, but I would think if you are staying at the same place with the same company shouldn't be an issue as long as you stay in the same department.

    e.g. if you start in IT as an engineer and then during the GC process you change to a managerial role this should be o.k.
    But it you shift from IT to sales with the same salary there would be an issue.

    I am in the same situation. I did not wait for 4-6 weeks for 221(g) and entered US using AP. The consulate called my home in India and was asking why I did not follow up my application? Should I withdraw my application by e-mail? Will there be any negative impact on my status in US?

    First of all you would need a visa to visit UK.

    I don't think Malaysian nationals residing legally in US and travelling to UK need a visitor visa...But I am not sure if UK visa law considers pending I-485 (AOS) a valid status....If you still maintain a valid H1 status but plan to re-enter on AP, you should be ok in my view...
