I'm not a Guru in Immigration Matters...still from my experience USCIS is pretty random in some cases with online statuses.

Date when LC is filed if its in a category where LC is required. If its NIW or Scheduled A then PD is date I 140 is filed.

u can file for a 3 year ext of H1 status under AC21 - This will enable u to continue in valid status while the retrogression eases if it ever will.
Also note that portability is allowed and u can switch employers during this period. u can retain ur current PD and use it for a later GC app if reqd

You need to consider all possiblities
1) Best case scenario: Your H1 gets approved before Oct in that case no need to do anything
2) H1 does not get approved by Oct 31 & No h4 applied then I am not sure if you are in status or not
3) If you apply for H4 and then you have H1 approval and subsequently H4 approval. In that case least you are in status but you will have to go out of country and get H1 stamped to remain on H1 status.
I would recommend option 3 as that is safest option though it involves money and stamping hassale it is worth it.

My H1b expires Sep 2009 and can apply for extension from apr 2009 onwards(6 months ahead). If for some reasons the extension gets denied by around Jun 2009 will I have to leave the country immediately or am I valid till sep 30 2009 as per the original H1B. Is H1B transfer after the denial and before the i94 expiry date an option? Thank you.

I believe the maximum time frame for an MTR is close to 6 months, but a lot of times it gets resolved sooner, with intervention from other agencies/groups.

How long is it taking now a days to get AP approval. I am from TX and e-filed on 2nd Oct (ND 4th OCT 2010) and want to know when I can expect the approval.
my spouse AP was approved last friday also from NSC and we recd the document just yesterday.

I'm in the same boat.
Applied for 485/Ap/EAD on July 18th. Pending I140 was approved on Sep 14th. Checked online status the same day and LUD was 9/14.
After reading your post today, I checked the online status again and the LUD is 9/17.

this is just like what people talk about IRS. I got packet in mail asking to contact immediatly field officer at local office regarding 2006 tax returns. Thinking worst, I didn't even go beyond subject line and everybody I talked or told, scared me to death. Finally, I mustered up courage to go line-by-line. Didn't understand what they were talking about and neither did the notice had my name or SSN. So left with no-choice, called IRS and found that documents were for previous resident!
Lession for me (and all) ... if you haven't done anything wrong intentially, their is nothing to be afraid about.

I have a question regarding my spouse who is on H4 visa.One of the company did H1b processing through "CONSULAR PROCESSING". Her H1B is approved now.
1) She is ready to work from Oct 1st as she got some project.Her employer said that they have to apply for amendment(COS) to get I94. Is this right?
The company either has to file a COS or she needs to leave the US and re-enter in H-1B status.
2) How many weeks will it take under premium processing to get new I94
15 calendar days for CIS to make a decision
3) Do they have to apply only after Oct 1.
No. Since she is already counted towards the cap, they can apply now but the start date will be 10/1 or later.
4) Are there any chances of getting rejected at this stage.
There's always a chance of a denial, but the risk is low if she is maintaining H-4 status when the COS is filed.

I did it about 10 days before scheduled date in July. Went around 2 PM. The guy at front desk was reluctant but let me in due to my case being genuine pregnancy after discussing with supervisor.

My H-1B petition is currently under processing in Vermont sevice center.
The receipt status shows it was recieved on May 8th and currently pending.
The processing dates on the USCIS website show May 31st as the current date.
Any reason why I still didnt receive a decision from USICS for my H-1B Petition? Does this mean anything? Or can i still keep the hope that I may receive a decision from USCIS?

Hi,
Dont know if this question has been asked before, but I recently got an extension and change of employer done using AC21 to a different company. I dont have an AP and dont have the time to get one. I am travelling to India next week and am scheduling an appoitment to get an H1B stamp. Will this be an issue? Is this considered abandonment of status?
Please let me know if someone else has been in this situation.
