I asked the same question yesterday at POE Boston.
He said I have to renew the AP before it expires. The Parole stamp is valid until an year from yesterday.
So when do you need to renew? Before June 17, 2009 ( your parole stamp validity) Or before the expiration of your original AP document?

Friends, here are my details:
EB3, India
PD: Feb 03
140/485 applied concurrently on July 23, 07 at TSC
140/485 Notice Date (from TSC): Sept 17, 07
Now, initially TSC had a processing time of 6 months for 140. They then changed it to a specific date later on. As of March 15, 08, it's about Aug 15, 07. Following the last few months' trend, my observation is that I might hear about my 140 sometime this month. However, it's just a guess - it might take longer.
When I call the USCIS (or even my attorney), I'm usually told that the dates on the site are just an estimate and even if my case is outside of the processing time according to their own web site, I can't speak with an immigration officer or do anything more about it. Is it true? I mean, say if I don't hear about my 140 this month at all and if the TSC processing time for 140 marches ahead well beyond Sept 17, 07 (my notice date), I can't even speak with an immigration officer?

Lost I20.
Went to school from 96 to 2000.
WOrking on H-1 since then.
Numerous trips outside. Last one in 2005 on an H-1 visa.
What do I do now?
That should not be any problem at all. I called my school's International office and they got my I20 from 99 scanned it and emailed it to me. I got it within half a day of making the call.

I'm sure the following questions have been asked several times too. What are the answers in the following scenarios:
After 485 filing and before 180 days:
- Person loses job and is unemployed. Does the 485 stage continue? Does AP and EAD assigned to this person still continue to work?
- If this person finds another job (based on EAD or H1), does the 485 process continue? Or does the whole GC process needs to restart?
After 485 filing and after 180 days:

Our payroll agency does the same. They do not even provide D-7 to the company because our payroll is incorporated with their other clients so that they can offer lower payroll fees. But they do print our company name in the paystubs. And if a need arises, they can make a copy for the requesting company for quarterly withholding summary.
I guess you can just ask certification from the payroll agency that your paystubs came from your petitioning company. I don't think it will create a problem. USCIS can verify if they want to.

I am not sure if Attorney is allowed to sign on place where it says : "APPLICANT"
u may have to give written permission/Notarized for that...
By signing Form G28, u are only authorizing the attorney to represent u in this case...not sign for u.

I am in the same boat.
Approved I-140 in EB3 category. Current employer wants to file in EB2 category, they gave me a new job that qualifies for the category but my Attorney says that I have to withdraw my current EB3 application..
I have read so many post here and every where that tells me that it is possible to continue the process but my lawyer says that I need to withdraw EB3 case.... Any one knows good lawyer around DC Metro area with good experience for Eb3 to Eb2 transfer with the same employer
You do not have to withdraw your EB3 application. You are doing the right thing by trying to find a new lawyer.

Dear Sir/Madam,
I am probably a unique case. I have a H1B that expires in Sep 2009. I work for a strategy consulting firm and as such advise clients on business/Ops strategy. Therfore most of the time I am on a client site. Recently, I moved my residence outside the US to UK. Given the nature of my work, I am able to commute to US every week to my client offices and then return to UK by end of the week. I sometimes have to go to European destinations and so UK actually helps.All through this I am with the same company on their US payroll (have US pay stubs, leters etc to prove). When I am in US, I stay at one of the hotels.
My question to you is, from a H1B standpoint, do I need to do anything different, especially given I am up for an extension later this year. I have an I 140 approved which will be the basis of a potential 3 yr extension.
Also note, that I get a new I 94 every week at the Port of Entry from the IO, so I have to believe that my case gets reviewed due to this unique situation
