Guys:
I am in my 9th year and have applied for extension (3 yr, based on approved I-140).
Now if my wife were to go to India and in a couple of months apply for her
H4-Visa stamping in Delhi. What are the documents that she needs to carry ?
Thanks

Hey, just be confident.. not all people get a chance to go in a place and apply for a job.. besides, if you have all the qualities of an applicant, there is no reason to be shy, rather tell your interviewer on what you can do to be an asset and help the company grows more.:D

Nothing written in stone but from anecdotal evidence.. NO
They process 485s according to RD.
Approval only comes after PD is current though

No you don't have to wait for your 3 year extension to return to US. Your lawyers and company are basically trying to get your three year extension so that you can get a 3 year visa stamped in your passport. But there's nothing stopping you from returning to US at any time on your current H1b.
For your second question - no you don't have to be present in the US to file for the extension .

Dear Sir/Madam,
I am probably a unique case. I have a H1B that expires in Sep 2009. I work for a strategy consulting firm and as such advise clients on business/Ops strategy. Therfore most of the time I am on a client site. Recently, I moved my residence outside the US to UK. Given the nature of my work, I am able to commute to US every week to my client offices and then return to UK by end of the week. I sometimes have to go to European destinations and so UK actually helps. All through this I am with the same company on their US payroll (have US pay stubs, leters etc to prove). When I am in US, I stay at one of the hotels.
My question to you is, from a H1B standpoint, do I need to do anything different, especially given I am up for an extension later this year. I have an I 140 approved which will be the basis of a potential 3 yr extension.
Also note, that I get a new I 94 every week at the Port of Entry from the IO, so I have to believe that my case gets reviewed due to this unique situation
Appreciate this offer of yours to help me.
Regards

Hi folks, i am in urgent situation and need your advice.
My 6-year H1B expires by end of April 2011 and I am quitting my job by the end of March and changing my status to H4. My I-140 has been approved, I-485 not submitted. Now I only have 1 month left in the 6-year H1B period and am in H4 after March, can I find a new employer to apply for H1B for me, using the 1 month? If yes, can the new employer apply for a 3-year H1B visa?
any comments/advices would be appreciated.

Dont you need the FP notice to even enter that building, the guard or the cop standing will not even let you in, if you dont have the FP call for notice.
I never heard of walk-ins :)
gcdreamer is right, you need FP notice. But if your question is if you miss your appointment date and then whether you can walk in another day, then answer is yes. I went to FP 2 weeks ago. A lady next to me, had FP notice dated 3 weeks earlier. The office let her get FP done.I personally did not do this.

Folks, let us concentrate on sending the output of all the good analysis done by various members to this person who it appears has a job to identify and recommend systemic fixes. It would be far more useful than sharing woes amongst ourselves in these b-boards.

I got the following email from my friend. Thought I would share it here.
Folks,
As most of you might know, there are a number of Immigration reform bills that are in various stages of their life in the US Congress. There is this 1 particular bill which is really important to people like us - Employment based legal immigrants from India & China: Bill 5882.
Highlights of the bill that are of use to EB applicants:
1) Would recapture unused Visas from past years and roll them over from one fiscal year to another.
2) EB 1, 2, 3 would become current and would remain current for quite a few years
I know some of you might have already got your greencard. But I am sure you know a number of others, many of them your close relatives and friends, who are stuck in this queue for a long time. If not for yourself, please take action for them.
Action needed:
1) Please go to http://www.opencongress.org/bill/110-h5882/show
Register your email address and vote YES for the bill.
How this helps: Online polling is an easy way for senators to gauge the popularity of a bill. If all the EB applicants were to VOTE yes, it
would take the number over 200,000 easily. The most popular bill has around 7000 votes. A bill on opencongress.com having 50,000 votes
is sure to garner a lot of attention.
2) Forward this email to all your friends and relatives who will benefit from this bill.
Only a systematic, organized online campaign would only us all to get LEGAL PERMANENT RESIDENT STATUS in the USA.
Thanks for your time!

Sorry to hear that...a simple mistake will cause your wait to become longer. I hope your lawyer or company compensated you for all the expenses you incurred during that period. It was truly frustrating.

Hi,
I-485 filed in july 2007. I-140 cleared in 2005.
We filed for GC in 2003 (eb3) in spite of my husband having two advanced degrees (M.Tech and Ph.d) but he is not working in the same field of ph.d. His company randomly filed in eb3 for all the employees.
But now my husband is diagnosed with chronic disease. We are thinking if we switch to eb2 since he is eligible to do that, atleast he would get some medical benefits for the treatment.
How do we proceed with this? Do we have to file labor again?
Any suggestions would be really appreciated.
how medical treatment is related to EB2? All you need is a good insurance.

Like many others we have been waiting for our AOS application to be approved for over 2 years. But the strange thing is, I did get an EAD approved but they never called me in for fingerprinting and Biometrics. I know I had to do the non-immigration "registration" that was initiated a few years ago and they had taken my fingerprints and biometrics, is that why they didn't call me in again? since they already have it?
Good to know this !
