The company will have to sponsor the H1 in full. Not enough to just give you an employment verification letter.
Also as per the rules, you cannot pay for the H1. Only the company can pay for it.

First of all if it is PP you will get possible approval in few days.
It may not be a good idea to go for stamping with only 3 months remaining on I-797; and these days they are also issuing 221g left and right.

I have a troublesome situation for which I need some help and potentially some legal inputs:
I am a green card holder with a priority date of april 2006.
I am planning to get married to an Indian citizen with no visa to USA (in fact, I tried to marry her before my green card got approved, but the way things turned out, I couldnt).
I now see that the priority for FB 2A is Aug/2010. If I were to marry her in Dec, can I file for her FB green card right away? How long would it take for her to the approval?
She is also working with her indian employer (software firm) to file for her H1B and/or B1. But, it is taking a long time.
Would a visitor visa or any other mechanism be possible? Could you please help me understand and fix my situation.
Can i go to India for a longer duration? How long can I move back to India without hurting my green card?

I am a physician who is doing his residency on H1b. My wife has applied for green card with a priority date 4/2004 (employment based category 3). I have applied for my green card with her. Now we are in I 485 stage.
NOw that the way dates are progressing it seems it will take a while for her date to become current for EB3. I was wondering if I apply for green card when I finish my residency, can I recapture the priority date?

1. Will your company keep your 140 alive? Meaning, will they withdraw it - I know a lot has been said about 140 PD being yours once approved and blah blah, but no one seems to report that they have successfully ported their 140 date to a new 140 application. This is strange but true. So I will make it doubly sure with my company.
2. Uscis might ask why your company is sponsoring two 140s for the same individual - your company should be prepared to answer that. This is exactly why my company refuses to reapply for the GC process for the same individual (it really raises a question of intent). Again, can be done, but needs full support from company

I have moved to san jose using AC21 last year but still have the address of my aunt in los angeles as they own a house , so that i do not have to go thru address change hassle, it is okay or do i have to provide my address

I mean stay on L1A (7 Year) with existing company. Apply green card through company B OR any other (For applying grren card, you don't need to be employee of that firm). Switch job as soon as you get I140 (premium process) approved from B company. If everything goes well, One year is enough to get I140 approval through premium process.

After changing the address on sunday, there were soft luds for 2 days on all pending 485.
Is this same with all address change.Last time it took 3 weeks to get the letter.

Wife got FP notice yesterday. None for me or my daughter. USCIS now has a new procedure where they will update the criminal background check without new fingerprints, unless old FP are unusable for whatever reason....That means no GC until end of July with all the remaining processing :(
Was hoping to be out of this agony earlier.......

This really seems moving now. This may be the best time for the CIR to get passed in Senate. Conference may be different ball game but right now momentum is picking up and we (IV) has to do one last effort for our amendments.

1. As to who will receive the receipt number? Will my attornery receive it or will I receive it?
Ans> If you attorney sent the app he will receive RN. I will receive ( if it at all comes ) at my home because i didn't hire an attorney.
2. Will it be a letter or an email from USCIS?
Ans > Letter in USPS mail.
3. I am the primary applicant. My wife may be offered a permanent position with the company she is working for on a consultant basis. Now the question is - Can she take the offer before her EAD is approved? I mean to say - Can she transfer her H1B processed for the company? Will she have any problem with the AOS application as her paper work (new I797) is changing? We are very confused with this.
Ans > If she has an valid H1B let her take the new offer by transferring H1B( if that company does H1B transfer) . EAD can be kept in lockers.
As long as she sent the latest I-797 when the AOS was applied that should be fine. Worst case USCIS may ask the new I-797 in an RFE.

Now because all embassies and consulates required to use PIMS to verify your H1B status... sometimes takes several weeks to get the passport stamped. In my case takes 3 weeks after interview to get my passport back (embassy at Lima, Peru).
So beware of the timing
I just bring a copy of my wife H1B approval and copy of lasts taxes ... just in case

My wife went to Chennai consulate for H4 visa when she is on OPT. Its been close to 5 weeks. They asked her to respond to some questionnaires (pink slip) and keep checking the case report status which is a pdf document being updated every Tue and Fri on http://chennai.usconsulate.gov/adminprocess.html . Since she is a PhD they need to do some background check on what kind of research and all that. The report still says "Pending processing". Th irony is, it says in the instructions that, if we contact them to find out the case status, it will take longer for them to make a decision.
Any input is greatly appreciated.

My current company has some issues, so If I apply my extension through my company I won't get my extension for sure.
So I contacted Company B , and applied for my H1 Transfer, they filed my H1 Transfer on 04/10/2009 through normal processing. I would like to know whether I need to switch from Normal processing to Premium Processing. If yes, then what's the procedure. I really appreciate all your time and efforts in answering my questions.

Still unresolved is the issue of green cards that have gone unused in the past decade or more. USCIS estimates that 10,000 green cards of the 140,000 allotted for employment-based applicants were not issued last year. Immigration Voice estimates that 200,000 in total have gone unused in the last decade. Immigrant advocates have been urging the federal government to offer make these green-card slots available to help relieve the backlog of those waiting for green cards, an estimated 500,000.
Using green cards from previous years would require legislation from Congress. Lofgren says there have been "some discussions going on informally" about whether such a move is possible. But it's no sure thing. It would be difficult to pass such legislation in a Congress that is leery of any immigration issue after a comprehensive reform effort with the support of President George W. Bush and bipartisan leaders in the Senate got shot down earlier this summer.
Meanwhile, immigrant advocates say they will continue to press to speed the process of turning workers with visas into permanent residents. "This [decision] helps us move from a more painful limbo to a less painful limbo, but it's limbo nonetheless," says Immigration Voice's Pradhan. "Adjustment of status is not our final destination; green-card status is."

If you are in the process of applying for H1 through another employer, you may be safe. As with everything USCIS, H1 revocation takes couple of months before it is approved. So in the interim you may get your new H1 approved before the previous employer's revocation sails through.
